By requesting services from Dawn Design Studio and acceptance of our terms and conditions you are aware that you are entering into a legally binding contract.
Any reference made to ‘the client’ refers to any individuals, businesses or companies (Client/s) engaging the services of Dawn Design Studio.
The terms and conditions apply to both Dawn Design Studio and the client.

Dawn Design Studio has the right to make changes to the terms and conditions, should Dawn Design Studio make changes they will notify you (the client) beforehand.

The below conditions have been constructed under Australian Law and apply to all individuals, businesses or companies (Client/s) engaging the services of Dawn Design Studio.

Any additional work, revisions or variations outside of the original Design Brief will be charged at an hourly rate. All prices exclude GST. Additional expenses will be charged accordingly. All quotes are subject to 3rd party supplier rise and fall in material costs such as printers.

Approvals:

All artwork and design are subject to written approval and a signed declaration stating that Dawn Design Studio’s terms and conditions are read and understood. 

Any variations to original design brief is subject to written approval and an additional charge at the standard hourly rate may apply.

The Client is responsible for approval of all Artwork including but not limited to; design, images, spelling, grammar, fonts and the working functions of web and illustrations. 

Dawn Design Studio will take all necessary steps to ensure accuracy however client approval to proceed will constitute acceptance that the client takes full responsibility for any errors overlooked within the design stage. The Client indemnifies the Company against any loss or damage arising directly or indirectly from any errors and omissions.

Ownership, content and copy right:

Ownership of copyright and Intellectual Property will remain property of Dawn Design Studio until final payment has been made at which time the ownership of copyright and Intellectual Property will be transferred to the client.

Artwork and Web designs/developments will remain property of Dawn Design Studio until final payment has been made in full.

Use of any Dawn Design Studio supplied or created content before final payment can only be authorised in writing at the discretion of Dawn Design Studio.

The client agrees to allow Dawn Design Studio the rights to use any artwork, graphics and completed projects created by Dawn Design Studio for self promotion unless otherwise agreed to in writing.

The client agrees to allow Dawn Design Studio to a credit and link at the footer of the website.

All images displayed on the Dawn Design Studio website, Facebook or Instagram page are subject to copyright and must not be copied or used without full permission from Dawn Design Studio and the Client.

All client supplied images must be provided in high resolution (300dpi) 

Any supply of stock images or fonts supplied by Dawn Design Studio will incur a cost.

Privacy:

Dawn Design Studio is committed to respecting the privacy and confidentiality of all its clients and will adhere to all relevant Australian laws and regulations regarding consumer privacy. We will not sell, trade or supply your information. 

Payment terms: 

A 50% deposit is required for all design and website development exceeding AUD$1,000.

Payment of deposit is required before any work can commence and be scheduled. Payment of deposit is deemed to be acceptance of the terms and conditions supplied by Dawn Design Studio.

The remaining 50% balance is to be settled upon approval of the design and website development prior to going live.

Dawn Design Studio reserves the right to add additional costs if the client initiates a change to the original design brief which falls outside the original quotation.

Payment in full is required for all design, branding & print work valued under AUD$1,000 before scheduling and commencement of work.

50% deposit for all design, branding & print exceeding AUD$1,000. 

All quoted design, branding & print work unless otherwise stated by Dawn Design Studio requires payment in full before scheduling and commencement of work.

Full payment is required 60 days after commencement of project regardless of the stage of any development. Where the client has not provided a response within 30 days of a design concept, web development or artwork being issued will be determined as acceptance of final works and Dawn Design Studio will then issue an invoice for payment. 

Where Debt collection is required to recover any monies owed to Dawn Design Studio this will be at the cost of the client (fees/commissions payable to debt collectors) 

Domains & Hosting:

All domain names are legally owned by the Client. All domain name registrations are subject to availability and registration rules. The Client manages their domain(s) and payment of fees unless the Client requests in writing that Dawn Design Studio manages the domain name(s) on behalf of the Client. Dawn Design Studio will invoice the Client when fees are due.

The Client indemnifies Dawn Design Studio against any loss or damage arising directly or indirectly from any failure of services provided by the Registrar who manages the Client's domain names.

The Client is responsible for contacting the chosen host for support relating to hosting matters. Dawn Design Studio will charge for costs incurred liaising with the hosting company and supporting the Client with hosting related issues.

The Client providing a third party server/host for websites will do so at their own risk. Dawn Design Studio ensures all website functionality and visual representation is correct before uploading to a third party server/host. Dawn Design Studio takes no responsibility for third party servers/hosts that have unforeseen limitations, restrictions or incompatible issues that may result in an error. Dawn Design Studio only guarantees the correct visual representation and functionality of a website at the time of publishing when designed and hosted within the Company's control.

Limitation of Liability:

In no event shall Dawn Design Studio and any external Contractors be liable for any lost data or content, lost profits, business interruption or for any indirect, incidental, special, consequential, exemplary or punitive damages arising out of or relating to the materials or the services provided by Dawn Design Studio.

Cancelation:

The Client may cancel this Agreement by providing a minimum of 10 days written notice to Dawn Design Studio, any deposit paid prior to cancellation is non-refundable.

Dawn Design Studio may cancel this Agreement at any time for any reason by providing written notice to The Client. In the event that Dawn Design Studio cancels this Agreement, Dawn Design Studio will provide any artwork completed and paid for to date.

Date
